For several weeks now, passions for new legislation in the field of postal items have not subsided on the Internet (and not only on it).

Our “value” limit for international parcels. Now, for those parcels that “cost” more than 22 euros and weigh more than 10 kilograms, you will have to pay a duty of 30 percent. Moreover, the total cost and weight are calculated for a month, and there is no gradation among the parcels.

That is, it doesn’t matter at all whether the goods arrived were ordered from foreign stores, or gifts from relatives, friends and other acquaintances. The same rules for everyone.

The exception is the EAEU countries (Russia, Armenia, Kazakhstan): parcels received from there are not subject to customs control at all.

What is the reason for such a sharp restriction?

Official government representatives talk about the need to fight illegal sellers who receive large quantities of goods not for personal use, but for sale.

Deputy Chairman of the State Customs Committee Vladimir Orlovsky gives the following figures as an example:

“Last year, over 250 thousand citizens of Belarus received from 10 to 100 or more parcels through MPO from online stores. The analysis showed that these goods were imported for commercial use.”

In addition, Chairman of the Council of the Republic Mikhail Myasnikovich believes that international parcels have collapsed Belarusian trade and created problems for, therefore he sees restrictive measures as protecting the national market.

Why exactly 22 euros?

The answer to this question is even simpler: because such a strict limit is established in most European countries. We by no means doubt that the Europeans are actively protecting their market, but we still decided to learn more about their best practices, as well as the experience of other leading countries of the world.

European Union countries.

Almost all EU member states have the same rules, and they do include an amount of 22 euros. But! There is a certain gradation.

Firstly, 22 euros is the limit for those parcels sent from commercial organizations. For those that are transferred “from an individual to an individual” (that is, simply put, for gifts), a different norm is established - 45 euros.

Secondly, the percentage of fees depends on the “value” of the parcel. Between 22 and 150 euros only VAT is charged (the tax amount is not the same for all countries, but fluctuates somewhere around 20 percent), more than 150 euros - VAT + customs duties.

In this case the size customs duties depends on the type of product. So, books are not taxed at all (by the way, VAT on them is only 7-9 percent). In Germany, for example, they are exempt from paying duties Cell phones and smartphones, game consoles, digital cameras, "flash drives". Tariffs range from 0 to 6.5 percent, for bags - from 3 to 9.7, for gold and silver jewelry - from 2.5 to 4, for clothes - 12 percent...

As for, for a cost of up to 700 euros, a reduced customs duty is charged (using the example of Estonia - 2.5%). Naturally, parcels within the EU are not subject to any taxes.

If we talk about exceptions, then we can include the UK: it is part of the EU for special conditions and therefore applies his special rules. True, only the amounts differ here, but not the approach.

The limit for commercial parcels is 15 pounds (about 19 euros), for gifts - 34 pounds (43 euros). For parcels up to £135 (€171), as in other EU countries, only 20 percent VAT is charged. If the “price” is higher, customs duties are also added (again, depending on what exactly is being sent).

By the way, one more nuance: if the amount of all additional fees does not exceed 7 pounds (about 9 euros), then it is simply forgiven.

Switzerland

As an example of a country that is located in Europe, but is not part of the EU.

Here duty free limit quite small - only 5 francs (about the same in euros). All commercial parcels of greater value are subject to VAT (8 percent, for books, magazines, medicines - 2.5 percent) and customs duties. The latter are calculated depending on the type of goods and its weight (usually less than one franc per kilogram), and books, laptops and other electronics are not subject to duties.

There is a limit of 100 francs for gifts.

USA

Parcels arriving here must clearly indicate: “as a gift” or “for personal use.” At the same time, for some reason, the “gift” limit is two times lower - $100 as opposed to $200.

If the cost of the package exceeds the specified amount of 200 dollars, but customs Service I didn’t see any goods for sale in the contents, VAT is not charged - you only need to pay duties: from 0 to 37.5 percent, depending on what exactly was delivered.

Canada

In this country, it also matters whether a person received a gift or an order from an online store. In case of excess, VAT is paid from the difference (the tax differs depending on the region - from 5 to 15 percent) and customs duties. In addition, Canada has signed free trade agreements with many countries (South Korea, USA, EU, Israel...), so parcels arriving from there are not subject to any fees.

Japan

The approach is almost the same, just with different amounts. Parcels up to 10,000 yen (about 90 US dollars) are not subject to any taxes or fees. From 10,000 to 20,000 yen - simplified tariff applies. If more - VAT (8 percent) + customs duties from 0 to 30 percent (as in previous examples, depending on the type of product).

In general, all countries protect their market and introduce limits for international parcels. But, as it turns out, some people know what exactly needs to be protected and to what extent.

And, of course, they can boast of their own production.

Previously, within a month, it was possible to receive parcels from abroad worth 200 euros and weighing 31 kg without paying customs duties. After the entry into force of Decree No. 40, the total value of goods must not exceed 22 euros and the total weight must not exceed 10 kg.

How much will you have to pay if this limit is exceeded?

If the cost is exceeded, customs duty is paid in the amount of 30% of the excess amount. For example, you received a product worth 50 euros, you met 10 kilograms, which means you need to pay:

(50 - 22) * 0.3 = 8.4 euros

If the weight is exceeded, a fee of 4 euros is paid for each kilogram over the limit.

Two duties at the same time (for the “extra” cost and weight) are not paid - only the larger amount.

Suppose you ordered a cabinet from a foreign online store that costs 80 euros and weighs 18 kilograms. Let's do the math:

(80 - 22) * 0.3 = 17.4 euros - customs duty based on the amount
(18 - 10) * 4 = 32 euros - customs duty based on weight
17.4 euros< 32 евро

It turns out that you will be charged a fee of 32 euros for the cabinet. It's time to think, do you really need this closet?

In addition to the duty, in both cases you must pay customs fee of 10 rubles.

And that's not all, postal items subject to customs duties are charged postage 5.88 rubles. This fee is charged by Belposhta “for presentation to customs and customs clearance of items that are subject to customs duties, for one item”. In other words, this is a fee for filling out documents and various forms, entering information into computer program at customs.

Belposhta can also charge you one more commission - 3.54 rubles “for providing missing information in the customs declaration”. This amount is paid for clarification of data, for example, if the recipient's address is incorrectly indicated in the shipment.

The total fee for exceeding the limit includes:

  • Customs duty (calculated based on value or weight)
  • customs duty
  • Postage

Customs duties are paid at the post office where the international mail is issued.

The effect of Decree No. 40 affects everything foreign parcels, however, parcels from the countries of the Eurasian Economic Union are considered intra-union postal items and are not subject to customs control. In addition to our country, the EAEU currently includes:

  • Armenia,
  • Kazakhstan,
  • Kyrgyzstan
  • Russia

Thus, the limit of 22 euros and 10 kilograms does not apply to parcels received from there.

What else is worth paying attention to:

  • The customs value of goods does not include transportation costs, in other words, if the goods cost 20 euros and delivery costs 10 euros, you will not have to pay duty.
  • You have the right to challenge the accuracy of the information indicated on the shipment. Let's say you bought a product at a discount. In fact, we paid 15 euros for it, and the seller indicated the full cost on delivery, for example 40 euros. In this case, you have the right to prove your case by providing the customs authorities with an agreement, invoice, sales receipt, payment receipt and other documents you have. And it’s better to do everything at once.

Also, Internet catalogs with publicly posted information on the cost of goods and printouts of bank transfer pages can be accepted as additional documents.

  • There are situations when the sender, for some reason, indicates an inflated price in the shipment. For example, you paid 20 euros for a product, but 30 is indicated, in this case you have the right not to receive it and inform the post office to have the parcel sent back. Well, or try to prove the true cost, as discussed above.

How to bypass the limit?

There are several options here.

Firstly, if you order several goods, and the price of each of them does not exceed 22 euros, you can ask relatives for help and indicate the details of your mother, grandmother, or brother as the recipient.

Secondly, you can contact the seller and ask him to indicate a cost that is less than the real one. But this is of course a slippery slope; at customs they may not believe that a bulky parcel with a fur coat inside costs 3 euros.

Attention ! To avoid any confusion, we warn you that the news concerns residents of Belarus! But, unfortunately, we suspect that we will soon have to write approximately the same thing for citizens of the Russian Federation.

On Thursday, the Belarusian president signed a new decree No. 40, which changed the limits on duty-free parcels. The amount is reduced by almost 10 times, and the weight by three times. The presidential decree will come into force two months after its official publication. The limit of 200 euros lasted only a year and a half.

“It has been established that customs duties are not paid in respect of goods for personal use sent in international mail during a calendar month to the address of one individual located in the territory of the republic, and (or) or imported into the territory of the country during a calendar month to the address of one recipient as goods delivered by the carrier, if the customs value of such goods in the aggregate does not exceed the equivalent of 22 euros and the total weight in the aggregate does not exceed 10 kilograms (previously 200 euros and 31 kilograms, respectively).”

If the limit is exceeded, the duty is 30%, but not less than 4 euros per 1 kg (levied on the amount exceeding the threshold).

The full text of the decree is not yet publicly available. But it is already clear that, most likely, the new limits will come into effect from mid-April.

Interestingly, the new limit of 200 euros lasted from July 2014, that is, a year and a half. Before this, the maximum cost of a parcel that Belarusians could receive without duty was 120 euros.

Let us remind you that the issue of limiting the volume of parcels from abroad has been discussed in Belarus for a long time. Back in November last year, there was talk about subjecting such parcels to VAT. The lobbyist for this decision was then the Chairman of the Council of the Republic, Mikhail Myasnikovich. He said that parcels from China had collapsed Belarusian trade and created problems for industry.

At the same time, the head of the Customs Committee of Belarus, Yuri Senko, stated that the number of parcels from online stores is growing exponentially: over the past four years it has increased more than 20 times. Customs was also going to limit the number of parcels.

The issue of limiting the number of parcels was even brought up for discussion at the Eurasian Economic Commission (EEC). Working group The EEC Council in the project proposed to reduce the threshold for duty-free online trade from 200 to 150 euros, and the total weight of parcels - to 10 kg. But they did not come to a consensus then. Kazakhstan opposed it.

Meanwhile on this moment in Russia they apply: 1000 euros in amount and up to 31 kilograms in weight per month. In Kazakhstan the situation is similar.

From April 14, 2016, limits on international parcels for personal use have been reduced to 22 euros and weighing no more than 10 kilograms. Previously, Belarusians could receive duty-free parcels from abroad for personal use worth up to 200 euros per month (regardless of the number of purchases) and weighing up to 31 kilograms.

Specialists from the State Customs Committee answered the most frequently asked questions about new limits on parcels from abroad, writes tut.by.

Is it possible to order several parcels per month for one person, so that the total cost is no more than 22 euros per month, or will it be possible to order only one parcel?

The duty-free limit on value (22 euros) and weight (10 kg) reflects the total value of all international postal items (IPO) per calendar month. In other words, within specified standards Multiple parcels may be imported.

At what point will it be considered that the parcel has arrived from abroad - at the moment it arrives at customs or at the post office? After all, sometimes it’s completely different terms. And you can receive goods at the post office at the same time, ordered in different periods, and not meet the limit, although each parcel individually did not exceed it.

The customs authorities take into account the date of registration of the parcel at the temporary storage warehouse. The specified date cannot be changed. In accordance with paragraph 4 of Article 160 of the Customs Code of the Customs Union, parcels are placed in temporary storage within 3 hours after their presentation to the customs authority upon arrival at places (institutions) of international postal exchange.

Will duties be charged on parcels that were sent, for example, in March, but arrived after April 14?

Yes, they will, if the customs value of the goods being sent exceeds the established duty-free import standards of 22 euros.

Example. Three parcels have been ordered, their cost is 22 euros, 5 euros and 1 euro respectively. All parcels arrive at different times, but within the same month. We pick up a parcel worth 22 euros without any problems. What will happen to the rest? What duties and fees will I have to pay when receiving the remaining two? State Customs Committee's response: Let's assume that the total weight of three parcels is up to 10 kg. After the duty-free release of a parcel worth 22 euros, in respect of subsequent parcels received by the same individual, customs duties and customs fees for customs operations are subject to payment for each parcel.

For the second international postal item, customs duties of approximately 6.5 euros will be payable: 5 euros (customs value of goods) x 30% + 5 euros (customs duty). The amount of customs duties for the third parcel will be about 5.3 euros: 1 euro x 30% + 5 euros (customs duty).

Let’s say that before the decree came into force on April 5, I received an international postal item in the amount of 30 euros. Under the previous rules, there is no need to pay a fee. And after the 14th in April I will receive another MPO worth 10 euros. Will there be a duty charge on it? After all, the law cannot have retroactive effect and MPOs received before April 14th should not be taken into account in the amount of 22 euros.

Subclause 1.1 of clause 1 of Decree No. 360 stipulates that the period for recording the facts of sending goods to an individual for personal use is a calendar month. This approach was not changed by Decree No. 40.

In the situation under consideration, before Decree No. 40 came into force, you had already received goods worth 30 euros in April. Consequently, after decree No. 40 came into force, you have already used the monthly norm of 22 euros and 10 kg for April.

How will parcels (gifts) from abroad (in our case from the USA) from close relatives be subject to duties and taxes? How much can they send us gifts for and how often?

Decree No. 40 did not establish any specifics (separate norms) for sending this category of goods (gifts).

Let's say parents live in the USA, won a Green Card, send a package (clothes, dishes, etc.), the cost of the items is not indicated anywhere. Do I have to pay a duty, since I didn’t buy anything myself, and no currency was exported from the country?

Yes, in case of exceeding the norms established by Decree No. 40. In accordance with part two of paragraph 1 of Article 316 of the Customs Code of the Customs Union, the calculation of the amounts of customs duties and taxes is carried out on the basis of information about the value of goods specified in the documents provided for by acts of the Universal Postal Union and used in customs purposes.

At the same time, in accordance with paragraph 2 of Article 361 of the Customs Code of the Customs Union, if an individual moving goods for personal use does not have original documents confirming information about the value of the gift, and the customs authority has reasonable grounds to believe that the information provided and (or ) the documents are not reliable, the customs value of such goods will be determined by the customs authority independently on the basis of the price information at its disposal for similar goods, including on the basis of data indicated in the catalogs of foreign companies carrying out retail sales similar goods.

The promotional item was purchased for 20 euros. The parcel arrived in two weeks or a month, the cost of this product on the seller’s website is already indicated at 35 euros. How will customs act upon the fact of assessing the value? What information must be provided?

An individual has the right to prove the accuracy of the information submitted to determine the customs value. To do this, he must submit documents confirming the declared value (contract, specification, invoice, sales receipt, payment receipt).

Sometimes it happens that a Chinese seller overstates the value of the goods in the declaration. For example, I buy an item worth 22 euros, i.e. actually paid 22 euros - an amount not exceeding the limit, and the declaration indicates the value, for example, of 40 euros. How can I prove that this package costs exactly 22 euros? Is it possible to provide screenshots?

If the recipient does not agree with the cost, specified by the sender, he has the right not to receive such IPO and inform the postal operator of the need to return it to the place (institution) of international postal exchange where the issue took place. After this, the recipient can contact the customs authority in writing and attach original documents confirming the value of the goods being sent.

If you disagree with the customs value determined by the customs authority for calculating customs payments, the recipient of the goods has the right to provide the customs authority with documents on the basis of which the customs value of the goods being sent can be determined (contract, specification, invoice, sales receipt, payment receipt, etc. ).

As additional documents, the customs authority may accept online catalogs with publicly posted information on the cost of goods being sent, printouts of bank transfer pages, etc.

How do customs authorities plan to differentiate between recipients? By full name, recipient's address, card from which payment was made?

The duty-free import standards established by Decree No. 40 apply to goods for personal use sent to MPO during a calendar month to one recipient, who is an individual located on the territory of the Republic of Belarus. It should be noted that according to subclause 2.2 of clause 2 of article RE 106 “Conditions for acceptance of parcels” of the Regulations postal parcels(Universal Postal Union Act), only one natural or legal person can be indicated as the addressee.

Thus, one individual during a calendar month can receive duty-free IPOs in an amount equivalent to no more than 22 euros and a total weight of no more than 10 kg, or several IPOs per month, if they do not exceed the specified limits.

The specified norm is calculated for each recipient upon receipt of goods at his address. Including minors.

It is possible that one parcel will be delayed and another will arrive earlier. As a result, the cost of parcels per month may exceed 22 euros. Is it possible to somehow avoid paying duties on the basis of payment receipts, from which it will be clear that the goods were ordered at different times and the cost of the ordered parcels does not exceed 22 euros per month?

The legislation determines that customs authorities the date of registration of documents submitted in accordance with customs legislation Customs Union for placing such goods in temporary storage. The legislation does not provide for any other procedure for calculating this period.

If the parcel still exceeds the cost of 22 euros, where do they pay the tax on it? At the post office upon receipt or do I have to go somewhere and pay?

Example. I ordered an external hard drive that cost $90 (or 82 euros). What duty will have to be paid in this case?

State Customs Committee's response: If the cost of the goods sent to the MPO for personal use is 90 dollars (which is converted to 82 euros) and the weight does not exceed 10 kg and no other goods were sent to the address of this individual during the calendar month, then the amount of customs duties payable will be calculated as follows: (82 euros - 22 euros) x 30% + 5 euros (customs duty for customs operations) - and will be 23 euros.

What happens if I exceed the limit and don’t want to pay and pick up the parcel?

If the recipient refuses to pay the accrued customs duties, the IPO will be returned to the sender.

If the cost of the parcel is indicated in Russian rubles, then what euro exchange rate will be applied? Will it be necessary to pay duty if during the delivery of the goods the amount exceeded the duty-free limit due to the growth of the Russian ruble against the euro?

The exchange rates of the US dollar and euro to the currency of the EAEU member state are applied on the day of registration of the customs receipt order.

Will there be new limits on parcels from the EAEU?

MPO sent between member states of the EAEU are considered intra-Union postal items and are not subject to customs control. Customs operations are not carried out in relation to them.

I am interested in the situation when the goods arrive in poor quality and the seller resends the goods. Will I have to pay the fee a second time? For example, I bought a camera for $100 with a 2-year seller's warranty. It broke before the €22 limit was introduced and was sent to the seller for replacement or repair. The camera is returned to Belarus after Decree No. 40 comes into force. Will tax be charged?

This decree does not establish any withdrawals in relation to any category of goods, including those resent by the seller in connection with the fulfillment of its contractual obligations for warranty repairs or maintenance.

In this case, the customs authorities will take into account the customs value and weight of goods delivered to an individual at the MPO during the calendar month.
In the case of sending goods for warranty repair or replacement without subsequent payment of import duties, it is necessary to confirm that these particular goods were previously imported and place them under the customs procedure of processing outside the customs territory. After this, the goods can be taken to the post office for forwarding to the seller.

If you make a purchase through an online store for an amount less than 22 euros (let’s say 20 euros) and weighing less than 10 kg, but delivery will cost 5 euros, and therefore a total of 25 euros, will it be considered that the limit of decree No. 40 will be exceeded and will you have to pay a fee?

In accordance with part two of paragraph 1 of Article 361 of the Labor Code of the Customs Union when importing goods for personal use individuals to the customs territory of the EAEU, the customs value of goods does not include the costs of transporting and insuring goods before their arrival and after their arrival in such territory.

Example. The package arrived, it says 60 euros: the product costs 32 euros, and delivery costs 28 euros, the weight of the package is 8 kg. How much will the duty be charged?

Answer: The weight limit for duty-free import (10 kg) is not exceeded. Delivery costs are not included. The amount of customs duties payable, calculated based on the customs value, will be 8 euros in the equivalent: (32 - 22 euros) x 30% + 5 euros (customs duty) = 8 euros. You will also pay a fee of 5.4 rubles to the post office for each parcel that requires payment of customs duties.

In Belarus, the threshold for duty-free import of goods in international mail will remain the same for now - no more than 22 euros and 10 kg per month.

At the same time, he noted that the situation that existed at the time the decision was made several years ago to reduce the limit on parcels to 22 euros “has not changed fundamentally.”

“That is, the volume of parcels has not stopped. If in 2015 about 6.5 million parcels arrived in Belarus, the trend of constant growth continues. But here it is important to note that the trend of importing mass quantities of goods has stopped. For example, in 2015, about 400 people in Belarus received more than a hundred parcels per year. That is, what kind of import of goods for personal use can we talk about? Now this figure is six times less, and we constantly monitor such people; they are under the control of both customs and tax authorities» , - said Kovalenok.

In addition, the representative of the State Customs Committee continued, as soon as the standard of 22 euros for parcels from abroad was introduced, cash receipts increased. Thus, in 2017, the treasury of Belarus received about 3.7 million rubles from individuals.

“Comparing 11 million parcels and 3.7 million payments, it turns out that each parcel brought in about 33 kopecks”, he noted.

The leadership of the State Customs Committee cannot yet answer unequivocally when and whether the current norm for parcels from abroad will be revised in Belarus in accordance with the latest decisions adopted in within the EAEU. Customs officers indicate that a decision on this issue should be made at a higher level, taking into account the opinions of all interested ministries and departments.

“In general, we need to look at how this will affect the economy of our country. The task of the State Customs Committee is to show commercial consignments of goods, we can cope with this"- said the head of the State Customs Committee Yuri Senko.

In 2016, Belarus significantly reduced the limit on duty free parcels from abroad. Now Belarusians have to pay customs duties if the cost of the ordered goods exceeds 22 euros and weighs more than 10 kilograms. If the limit is exceeded, the addressee will pay 30% of the excess amount (but not less than 4 euros per kg), as well as a customs fee of 5 euros. Previously, in Belarus the limit on parcels for personal use was 200 euros and 31 kilograms per month.

At the end of 2017, the EAEU approved the concept of a gradual reduction customs limits, which includes goods that are delivered to the buyer from abroad through international mail or by a carrier, including purchases in foreign online stores.

In particular, within three years the EAEU countries must adopt uniform limits at the maximum cost and weight of parcels from abroad. If the decision is made, Russia and Kazakhstan will lower their limits from 1,000 euros to 200, and Belarus could raise them from 22 to 200.

According to the decision, from January 1, 2018, a limit of 1,000 euros and 31 kg per calendar month is expected to be established. From January 1, 2019, for one calendar month, without paying customs duties and taxes, it will be possible to order goods totaling up to 500 euros and weighing no more than 31 kg. In addition, all restrictions on time and number of orders will be lifted.
