The first store I got into was "My Auchan" on Tverskaya. It opened in August last year literally a stone's throw from the State Duma. The people are dark. Especially tourists. And everyone is pushing each other, apologizing, because there is not enough space, despite the two floors. To begin with, I took four packaged packages - buckwheat (unground), wheat flour, a half-baked horn (pasta, in our opinion) and rice (long-grain). And he went with them to look for control scales. As it turned out, the sellers of "Auchan" have nothing to be ashamed of. Those bags that I bought are underweight only for flour. And then - only 2 grams! And buckwheat, rice and pasta, on the contrary, have an overweight - from 4 to 30 grams. Well, where, one wonders, is the deception?

LET'S GO LOOK FOR A POTATO

Attempt number two. Perekrestok store on Yasnogorskaya Street (south-west of Moscow). I put the scales in a storage box (no palette, as they say) and proceeded to the display cases. I took the vacuum-packed sausages (who knows if the weight indicated on the barcode corresponds to the real one?), Another pack of flour, a net of potatoes and three lemons (firstly, because my throat was tight, and secondly, recheck the store scales , those on which buyers weigh vegetables and fruits).

Checkweighers were available at Perekrestok. And they stand next to the extreme cash register. The sales assistant, seeing me weighing a packet of flour, looked at me as if I were the last miser. But I steadfastly withstood her gazes and hastened to write down the results. Lemons - grams per gram, flour - too, sausage - 4 grams underweight. But the underweight of potatoes is 112 grams! This is too much. After all, this is a whole potato. And if you consider that I buy potatoes once a month, then this is 12 potatoes per year. Decent casserole of borscht. My scales showed the same ...

Sellers told me that not many people use checkweighers in their store. Mostly retirees. And only fruits and vegetables are weighed, but not packaged products.

WHERE DO I HAVE SO MANY PASTA

On Novoyasenevsky Prospect, I choose another chain supermarket “I am Favorite”. Perhaps the quietest of the three. The area is large, there are not so many people. I chose the products at random. The results are not overwhelming. Rice underweight - 5 grams. Buckwheat underweight - 10 grams. But with pasta, the overweight is as much as 20 grams! So it turns out that I am not enough rice with buckwheat, but I got pasta for free. There are no problems with breadcrumbs and sugar - in both cases the overweight is 2 grams.

Perhaps the underweight of the ordered dish is one of the most offensive phenomena that catering customers face. Restaurateurs like to underweight in different ways. Most often we are talking about the banal "minus 30-50 grams" in a salad, the output of which on the menu is 300-400 grams.

Anything can be underweight: appetizer, soup, hot second and even dessert. The calculation is based on the fact that the client will not make claims, because, firstly, he is hungry and, as a rule, in a hurry, and secondly, he will hardly be able to prove the absence of grams of food in the plate on the spot.

There are also more sophisticated methods, for example, replacing the ingredients of a dish. Some readers have repeatedly complained about the cases of replacing the cheese "Mozzarella" with the Soviet "Poshekhonsky" in the capital's restaurants.

Another "business" is underfilling. And okay, if they brought you a decanter of vodka, where instead of the ordered 200 grams, 150 are splashing. In this case, you can get the measurement of the liquid from the bartender who has a beaker.

But what if they brought you, for example, a glass of an alcoholic cocktail full of ice? That is, instead of the ordered 200 grams of cocktail, the maximum you drink is 100–150 grams. The rest will be water in the form of ice cubes. At best - from the filter, at worst - from the tap.

By the way, banquet "extortions" can be considered a separate topic of conversation. The observer, who himself worked at one time in a public catering, witnessed how the "carve-up" of food and drinks between restaurant employees takes place.

In fact, only 60–70% of what is ordered goes to the table in the form of snacks and alcoholic cocktails. The "extra" food remains in the storerooms of the restaurant, and the imported alcohol is shared fraternally between the waiters and bartenders.

Who makes the menu?

According to STB 1209-2005 “Public catering. Terms and definitions ", a menu is a list of products of own production located in a certain order, purchased goods offered to the consumer in a certain period, indicating the mass, volume or other measure of the unit of the product (portion) and the price; wine list - a list of alcoholic beverages arranged in a certain order, indicating the volume or other measure of a product unit (portion), price.

The menu is drawn up on the basis of the assortment list of products of own production and goods sold by the local executive and administrative bodies.

In accordance with the "Recommendations for the preparation and design of menus in commercial catering facilities" (approved by the First Deputy Minister of Trade of the Republic of Belarus M.I. other nations, the menu must include an assortment of dishes of the Belarusian national cuisine.

The menu indicates name of a dish, product, weight, volume or other measure of a product unit (portion), their price. For alcoholic beverages, the menu indicates the capacity of the consumer container and the price, as well as the volume and price of the portion. The serving size of alcoholic beverages is determined by the pricing instructions for public catering facilities.

For champagne and sparkling wines, the price on the menu is indicated per unit of their consumer container. For certain forms of service (buffet, reception, etc.), it is allowed not to indicate the output of dishes, products and their price in the menu.

The output of dishes is determined and indicated in the menu, taking into account rational consumption rates (salads up to 100-150 g, hot snacks - 70-100 g, soups - 250-300 g, hot dishes - 100-150 g, side dishes - 150-200 g and etc.).

In the menus of restaurants, cafes, bars, the composition of dishes and products may be indicated, photographs of the dishes sold may be placed. The name of the dish, its output are indicated in accordance with the technological documents for its production.

How to deal with underfilling and underweight?

Despite the fact that in the Belarusian legislation there are documents that give recommendations on how the menu should be drawn up, unfortunately, there is no information on what to do in case of an obvious underweight or underfilling. With this question, we turned to the main department of the consumer market of the Minsk city executive committee.

According to the head of the catering department Irina Shulyakovskaya, in case of obvious detection of underweight / replacement of ingredients, it is necessary to demand a control measurement of the portion weight on the spot. You have the right to contact the waiter with a request to carry out a public overweight either of the entire volume of the ordered dish, or in its components separately. At the address request, the overweight process can take place both in the kitchen in the presence of the client and in the service hall.

“If you are denied an advantage, you can record this in the Book of Comments and Suggestions, and also send an additional appeal to the main department of the consumer market of the Minsk City Executive Committee, or to the Ministry of Trade of the Republic of Belarus. On a specific fact, checks will be carried out, ”said I. Shulyakovskaya.

As noted by the leading specialist of the Legal Services Center Alexey Nesterenko, one of the basic consumer rights established by the Law of the Republic of Belarus "On Protection of Consumer Rights" No. 90-З dated January 9, 2002 is the right to receive necessary and reliable information about the offered goods (works , services).

According to paragraph 5 of Art. 7 of the said Law, it is envisaged that when providing public catering services to a consumer, at his request, information on the composition of food products, dishes, culinary products specified in the menu, and methods of their culinary processing must be provided.

As a rule, information about the composition of the dish is brought to the attention of the consumer by indicating the ingredients and their quantity (weight) in the menu. Of course, the dish must exactly match the information provided to the consumer.

The absence of the declared ingredients, the substitution of one ingredient for another without the consent of the consumer, the discrepancy between the mass of the dish and its ingredients stated in the menu is not allowed.

If the consumer was not provided with complete and reliable information about the ordered dish, which entailed undesirable consequences for the consumer, then the consumer has the right, at his discretion, to demand: replacement of the dish or immediate gratuitous elimination of deficiencies; a commensurate decrease in the purchase price; return of paid funds (in case of refusal to use the dish). The consumer also has the right to demand compensation for losses, if any.

If the catering service provider (cook, waiter, bartender, etc.) deliberately replaces ingredients with cheaper ones, underestimates the weight of the dish (ingredients) in comparison with that indicated in the menu, then such actions may qualify as consumer fraud, which is part of an administrative offense under Art. 12.16 of the Code of the Republic of Belarus on Administrative Offenses.

If the violation in question is allowed at the direction of the head of the catering establishment, then there is such an administrative offense as violation of the rules of trade and provision of services to the population, which entails the imposition of a fine, and may also result in the revocation of the license for retail trade and catering.

However, it should be noted that the violation in question is difficult to prove and is revealed, as a rule, only through a test purchase.

Please note that an application with a request to conduct a test purchase in a specific restaurant should be addressed not to the catering department of the main department of the consumer market of the Minsk City Executive Committee, but to the department for combating economic crimes of the Ministry of Internal Affairs of the Republic of Belarus, or to the tax service at the place of registration of the catering point.

There are a great many different shenanigans in restaurants. Among them there are popular, rare and very exotic ones. The purpose of the deception is simple - gain or disguise the shortage. Fraud in a restaurant is rarely at the point of a single person - a waiter or a bartender. In the overwhelming majority of cases, this is a conspiracy, including with the restaurant manager. Of course, if the latter is not the owner of the restaurant, but a hired manager. A waiter, especially an experienced waiter, when taking an order, focuses on several parameters - what is the number of the company, how much alcohol is ordered, how the menu is carefully studied (price list). A recommendation, without leaving the checkout - carefully look at the menu, pronouncing each item of the order (dish, drink) and, of course, its price! As soon as you or your "companions" at the feast begin to name prices, discuss them, add them up (albeit jokingly), the waiter will not cheat you. This is verified.

How can we be deceived in a restaurant? There are many ways, let's talk about the easiest and most common ones to implement.

Underfilling a drink at the bar. Instead of the ordered 100 grams, the bartender pours 95 or 90. Only he can do this by eye, the difference is imperceptible to you. In total, from ten portions, one more, unaccounted for, is obtained. And if it's vodka, then the fat is not impressive, but if it's some kind of mojito or, even better, something like Truffle Martini for a hundred dollars? There, the amount of "left" income per shift can reach the size of the monthly salary of an average Russian.

Underweight snacks. Ask the bartender for 200 grams of dried ram or octopus - 180 is served. Imperceptibly on the eye, in the pocket of a fraudster - very much even.

Believe me, a bartender with experience, with a high degree of probability, can recognize in your companion a regular restaurant and wine connoisseur. The half-eaten meals, after cosmetic manipulations, are again served to the visitors. Navar is double - and the first "sampler" paid for it, and the second paid. Note! The ability to bring the seller to justice will directly depend on how the fact of weighing is revealed. If the violation is established directly in the store, as a rule, there are no difficulties in restoring the violated right.

In practice, if an inspection by Rospotrebnadzor establishes a violation, the court fully satisfies the stated requirements.
