Jewelers suspected of tax evasion for billions of rubles

"Adamas" in 1993 was created by retired officer-financier Andrei Sidorenko and co-operator Vladimir Veremeyev, Forbes magazine reported. In the 1980s, entrepreneurs traded matryoshka dolls and "palekh". As Veremeyev said in one of his interviews: “Everything that folk craftsmen from the nearest Moscow region do, passed through a large network of our outlets and stores. Then they decided to do gold - they wanted something new. We started from scratch: we took out a bank loan, bought machines, launched a plant, ”Veremeyev said. The Adamas company has become one of the largest jewelry chains. But lately she's been in trouble with debt. In the summer, the bankruptcy procedure began for three companies of the Adamas group - the Stolichny Jewelry Factory, Adamas-Yuvelirtorg and Adamas-Jeweler. The company continues to negotiate with creditors.

The court ordered "Adamas" to keep jewelry for 1.2 billion rubles at the claim of Sberbank

Sberbank succeeded in obtaining interim measures against the Adamas-jewelertorg company, which is engaged in retail trade in the Adamas jewelry holding. The Moscow Arbitration Court granted on February 18 the bank's petition in the framework of the bankruptcy of Adamas-Yevrustorg, it follows from the materials of the court.

Everything was "Adamas"

The company was founded in 1993 by retired officer-financier Andrey Sidorenko and co-operator Vladimir Veremeyev, who traded matryoshka dolls and "Palekh" in the 1980s. Until the early 1990s, the creators of Adamas had nothing to do with jewelry.

Everything that folk craftsmen from the nearest Moscow region do was passed through a large network of these outlets and stores.

The owners are hiding behind three offshore companies: Luxembourg-based Spencer Holding S.A., which owns 61% of Adamas, Cypriot Tollcross (20%) and Sand Independence, registered in the British Virgin Islands (19%).

Note that sources in the Research Institute of TP and the Guild of Russian Jewelers say that among the owners of "Adamas" are definitely Andrey Sidorenko and Vladimir Veremeev, the owner of the hotel and restaurant "Gallery" in Abramtsevo.

PRECIOUS METALS AND STONES MARKET (VPS): "The Lord of the Rings"

Pavel and Andrey Sidorenko, the owners of one of the country's largest jewelry manufactures, ADAMAS, began developing their own retail network later than their competitors. Market consolidation is forcing all players to rapidly increase their presence in retail, and the struggle is going on, if not for the richest and most demanding, but a mass buyer who chooses goods in the lower price category.

In this situation, the owners of "ADAMAS" again went against the tide: instead of grandiose sales, the company decided to launch a new project - a chain of discounters "Jewelry Bazaar" and become the first Russian multi-format jewelry chain. This will allow her not to lose her original positioning and win over a low-income and thrifty audience. But in this way the Sidorenko brothers actually give up their attempts to transfer ADAMAS from third to first place in terms of the breadth of its presence on the market: by developing two networks at once, they will definitely not keep up with the leaders.

Medals for the Olympic Games in Sochi will be made by the company "Adamas"

The corresponding agreement was signed yesterday, March 13, in Sochi. On behalf of the Organizing Committee, it was signed by its president, Dmitry Chernyshenko, on behalf of the company, by the chairman of the board of directors of Adamas, Andrey Sidorenko.

Golden transit

Finally, the leader of the troika, the largest Russian jeweler "Adamas", started right away with production. This company was founded in 1993 by a retired officer-financier Andrei Sidorenko and a co-operator Vladimir Veremeyev, who traded matryoshka dolls and "Palekh" in the 1980s. “Everything that folk craftsmen from the nearest Moscow region do passed through a large network of our outlets and shops,” Veremeyev said in an interview with the newspaper “Vperyod” (Sergiev Posad). - Then they decided to do gold - they wanted something new.<…>We started from scratch: we took out a bank loan, bought machines, launched a plant. "

The rented half-floor in the Moscow Research Institute of Precision Instruments - the "mailbox" that once developed space communications systems, became the "plant". There were placed Italian machines for the production of gold chains, recalls the marketing director of "Adamas" Pavel Sidorenko (the younger brother and partner of Andrey Sidorenko). “Andrey and Volodya came to us for advice, bought a semi-finished product - gold wire,” says Alexander Ivanyuk, general director of the Moscow special alloy plant and head of the Russian Guild of Jewelers. - These are talented guys. Starting from scratch, we quickly caught up and overtook Bronnitsy. " (There was a large Soviet-built factory for the production of jewelry chains in Bronnitsy near Moscow.)

Andriy Sidorenko: "We are in a relaxed state"

Andrey Yuryevich, does the company have difficulties associated with unfair competition between small trading companies that sell counterfeit and low-quality products?

Andrey Martsevoy left the post of CEO of the company "Adamas"

- The question of why Pavel Yuryevich Sidorenko left his post almost simultaneously with you has caused heated debates among many of those who are somehow interested in the fate of Adamas?

- This question, and in fact, I have been asked several times lately. I will clarify in order to debunk any speculation. Pavel Yurievich is one of the owners of the company. At the meeting of the founders, including all the owners of the company, it was decided to create a single management body from the board of directors. Andrey Yuryevich Sidorenko was elected chairman, and Pavel Yuryevich still holds a leading position, being a member of the board of directors.

Olympic and Paralympic medals will be produced by the Russian company "Adamas"

The Sochi 2014 Organizing Committee has decided on the company that will produce the Olympic and Paralympic medals, the Russian Adamas. The corresponding agreement was signed in Sochi by the president of the organizing committee Dmitry Chernyshenko and the chairman of the board of directors of “Adamas” Andrey Sidorenko, reports.

“The honor and responsible mission of producing the Olympic and Paralympic prize medals fell to the Adamas company. Medals are the main trophy of the competition, and exactly what every athlete dreams of and will fight for at the Games in Sochi. Our partner will make 1.3 thousand medals, ”said Chernyshenko.

"Adamas" won Olympic medals

The Adamas Jewelry Company will produce medals for the 2014 Olympic and Paralympic Games in Sochi. Today the president of the Sochi 2014 organizing committee Dmitry Chernyshenko and the chairman of the board of directors of Adamas Andrei Sidorenko signed an agreement, according to which the company becomes the official supplier of the Olympic Games in the category “Jewelry, precious metals, stones and medals”.

Adamas promises to produce innovative and interesting medals for the Olympic Games

On Wednesday, Dmitry Chernyshenko, President of the Sochi 2014 Organizing Committee, and Andrey Sidorenko, Chairman of the Adamas Board of Directors, signed an agreement, according to which the company became the official supplier of the 2014 Olympic Winter Games in the Jewelry, Precious Metals, Stones and Medals category.

The head of "Adamas" Andrey Sidorenko will receive a "reward" from the investigators

Dmitry Naumov

The whole world is eagerly awaiting the 2014 Winter Olympics in Sochi, while at the same time never ceasing to be amazed at the outrageousness that is happening around the preparation for the games. Their cost broke all records at the start of the project - there were no such expensive Olympics in the entire history of the movement.

However, in the course of business, money began to be sharply lacking. The increase in costs compared to the initial estimates of the project is a direct result of vulgar corruption and theft, which are confirmed by the results of numerous audits and three dozen criminal cases.

It got to the point that the government, the Ministry of Internal Affairs and the FSB of Russia were forced to prepare "a comprehensive plan of measures to prevent and suppress the facts of corruption, other abuses in the use of budget funds with the participation of officials and offenses in the exercise of power" during the preparation of the 2014 Olympics ".

And now, when it would seem that all the money has already been stolen and "drank" it got to the saint - the Olympic medals. The head of the Organizing Committee Dmitry Chernyshenko on the official website in March 2013 said: “The honor and responsible mission of producing Olympic and Paralympic medals fell to the leader of the Russian jewelry market - the Adamas company. True, for what merits it is not clear.

Nevertheless, the corresponding agreement was signed with Andrey Sidorenko, chairman of the board of directors of OOO Adamas Capital Jewelry Factory. The cost of producing the medals was not disclosed. It is only known that their design includes soldering from a glass fragment.

Meanwhile, the Adamas company itself came to the attention of law enforcement agencies. As a result of simple manipulations, together with the former head of the enterprise, Adamas owed more than 70 million rubles to the Prioksky Non-Ferrous Metals Plant (PZTsM) for 200 kg of gold bars received in 2009. And now, as a result of a long investigation, this story has turned from a civil-legal plane to a purely criminal one. Now, instead of being proud of our country, we will all have to blush for this actually stolen gold, from which the Olympic medals will be made.

On May 27, 2013, the Kasimovsky District Court of the Ryazan Region sentenced the former General Director of the Prioksky Non-Ferrous Metals Plant (PZTsM) Alexander Boguslavsky, who was found guilty of abuse of power that caused damage to the company in the amount of 191 million rubles. According to the verdict, four years ago, a businessman “in order to derive material benefits for himself, as well as for the companies associated with him, entered into deals that were obviously unfavorable for PZTsM”. He was sentenced to three years in prison and banned from holding leadership positions for one year.

One of these companies is Adamas. The bottom line is this. In the summer of 2009, PZTsM and Adamas entered into an agreement for the supply of gold in bars per 100 kg. The price of gold was fixed at the date of shipment based on the evening London fixing plus 1% with a payment delay of six months. PZTsM delivered goods for 112 million rubles.

After Adamas paid only a third, Boguslavsky entered into an additional agreement and delivered another 100 kg of bars with a deferred payment until February 2010. When it became clear that the jewelry plant was not going to pay, Boguslavsky and Adamas entered into six additional agreements one after the other. In the end, the maturity of the debt for gold was extended until January 2011. During this time, "Adamas" paid the plant about 50 million rubles, which is less than a quarter of the required amount. It should be noted that on the days of gold shipments, in the period June-November 2009, the price per gram ranged from 950 rubles to 1006 rubles. And in January 2011, a gram was already worth 1,323 rubles. That is, Boguslavsky provided deferrals in the face of a steady rise in gold prices, which undoubtedly was beneficial to Adamas, but increased the losses of PZTsM.

How many "Adamas" rolled back the former general director Boguslavsky for these transactions, the investigation is now investigating. The jewelry factory did not return the money for precious metals, taking into account losses, in full. Now PZTsM is forced to recover its own through the arbitration court.

In the meantime, the trial and business, the company melts Olympic medals from the stolen gold. And again on special conditions. In any case, we could not find any information on the holding of a competition or public procurement procedure for the production of Olympic medals on the official website of the Olympic Committee. There are fears that a story similar to the scam with the Prioksky non-ferrous metals plant would not repeat itself, but now on a national scale. As you know, athletes receive medals for the best results in each discipline. "Adamas" has already set its record, proving to the whole world that in preparation for the Olympics in Sochi, you can earn twice: on the state order for the production of Olympic medals and on the gold stolen for them. We can only hope that the head of Adamas, Andrei Sidorenko, will receive his “award” not as a result of behind-the-scenes agreements and fraudulent schemes, but as a result of an honest and impartial investigation by law enforcement agencies.

Sberbank filed a bankruptcy lawsuit against OOO Adamas-Yuvelirtorg, OOO Adamas-Yuvelirtor and OOO Zolotaya Chain, previously owned by Adamas-Yuvelir. Meanwhile, the general director of Adamas-Yuvelirtorg Artur Astashin is under investigation. The businessman is suspected of tax evasion in the amount of 400 million rubles. Astashin case
Recall that the reason for the initiation of the criminal prosecution of Artur Astashin was the materials of the check carried out some time ago by the security officials of the Department of Economic Security and Anti-Corruption of the capital's Interior Ministry Directorate and the tax authorities.
The inspectors came to the conclusion that the head of Adamas-jeweler-trading Astashin in 2013 introduced false information into the accounting tax statements of the organization and ensured its submission to the tax authority.
As a result of the fraud, 400 million rubles were not paid to the budget.
Trying to get a tax deduction, Mr. Astashin presented a contract to the tax office, according to which Adamas-Yuvelirtorg received jewelry products and blanks for them from a certain LLC.
True, the contract was signed with a one-day company that does not engage in any production and financial activities and was registered to people who did not even know about it!
Moreover, according to some reports, under a dubious contract with a suspicious LLC, the cost of the allegedly supplied products is overestimated. From jeweler to suspect
The owners are hiding behind three offshore companies: Luxembourg-based Spencer Holding SA, which owns 61% of Adamas, Cypriot Tollcross (20%) and Sand Independence, registered in the British Virgin Islands (19%).
Note that sources in the Research Institute of TP and the Guild of Russian Jewelers say that among the owners of "Adamas" are definitely Andrey Sidorenko and Vladimir Veremeev, the owner of the hotel and restaurant "Gallery" in Abramtsevo.
Chairman of the Board of Directors of the company - Andrey Yuryevich Sidorenko. Executive Director - Weinberg Maxim Yurievich.
Net profit margin "Adamas" does not disclose. But it is known that production brings on average 7% in the industry, trade in the mass segment - from 30 to 35%, in the premium segment - about 50%, in the luxury segment - from 70%. Sidorenko assures that in the B2B sector the marginal profitability of Adamas' sales is 10% higher than that of all direct competitors. And in the B2C sector, it is “one and a half times”. "Figuratively speaking"
It is worth noting that the executive director Weinberg is involved in the proceedings on the dubious loan.
Rumor has it that there was corruption behind the contract for the production of medals for the Olympics, which was signed by its president Dmitry Chernyshenko on behalf of the Olympic Games organizing committee, and Andrey Sidorenko, chairman of the board of directors of Adamas, on behalf of the company ... these rumors.
By the way, in 2007 "Adamas" appeared in another case. Investigators visited the offices of the leaders of the jewelry house. The main complaint was that the jewelers did not send the metal obtained after processing at Pirit for refining. Among those who were summoned to the authorities for an interview were representatives of well-known enterprises that have long been present on the market and have earned a high reputation.
Then in relation to the head of LLC "Capital Jewelry Factory Adamas" it was planned to allocate material with the subsequent initiation of a criminal case. In addition, the investigator explained that he intends to conduct searches on the territory of the enterprise and at the place of residence of its management. But the matter settled down.
At the moment, the company has 157 own stores and 60 franchise stores, the average check in which is about 8,000 rubles.
Sberbank, of course, was seen in a number of raider attacks on enterprises. But Otkrytie FC also has complaints about Adamas. The bank filed lawsuits for bankruptcy this summer, but the companies challenged the opening of proceedings on the cases, citing the fact that the three-month delay on debts had not yet expired.
Let us remind you that in October Otkritie filed repeated claims, trying to bankrupt the production asset of Adamas, OOO Stolichny Jewelery Plant, but the court turned it down. On October 1, Stolichny Jewelery Factory introduced supervision on the claim of another creditor - Voronezh LLC Zolotorg! This company was formerly called LLC "Adamas-Classic", and in June it itself was declared bankrupt.
The situation is favorable for manufacturers and sellers of jewelry - devaluation has made these types of goods more competitive. But for some reason the top management of Adamas ran out of money. Now they will be looked for by the court and law enforcement agencies.

The five missing billions of the Adamas group.

The problems of the Adamas group, created in 1993 by retired officer Andrei Sidorenko and co-operator Vladimir Veremeyev, were discussed in February. Then Sberbank managed to achieve in court the introduction of interim measures against a subsidiary company - "Adamas-jeweler-trading", which owed the bank 2.4 billion rubles. Artur Astashin, director of Adamas-Jeweler Trade, was accused of tax evasion in the amount of 400 million rubles. Prior to that, the Moscow Arbitration Court was hearing the case on the bankruptcy of two companies of the group: the Stolichny Jewelry Factory (the plaintiff is Zolotorg) and Adamas-Jeweler (the plaintiff is Vadim Belyaev's Otkrytie Bank). As for the jewelry factory, its problems may turn out to be even more serious than those of Adamas Jewelry Trade. Its director, Andrei Shumaev, is suspected of tax evasion in an amount much more significant than Astashin was charged with.

The case against OOO Stolichny Jewelery Plant was initiated by the State Investigative Directorate of the Investigative Committee of the Russian Federation in Moscow on the basis of materials from the Federal Tax Service (FTS). Violations were revealed during one of the on-site inspections conducted by tax authorities in 2016; in addition to the TFR and the Federal Tax Service, the FSB and the GUEBiPK of the Ministry of Internal Affairs participated in the investigation. It was established that the criminal scheme operated from 2012 to 2014. Its organizer, according to the investigation, was Andrei Shumaev and as yet unidentified persons from among the management and employees of the enterprise. It could be Andrey Sidorenko, Vladimir Veremeyev, and also the executive director of Adamas Maxim Weinberg.

In order to avoid paying taxes, the Adamas managers created a fictitious workflow with more than 50 one-day firms. Those entered into agreements with banks, through whose accounts precious metals were received. Thus, the Sidorenko jewelry factory, according to the investigation, avoided paying value added tax. According to the calculations of the tax authorities and the TFR, due to the actions of the jewelers, the budget in total received less than 5 billion rubles.

In the course of the investigation of this criminal case, searches were carried out in four offices of the company, including on Dekabristov Street and Selskokhozyaistvennaya Street, as well as at the place of residence of the company's managers and employees. There, law enforcement officers seized documents and electronic media.

In Adamas, Kommersant was told that the company was providing assistance to representatives of law enforcement agencies, but did not comment on the work of the TFR and “other bodies” until the completion of the investigative actions. At the same time, the initiation of a criminal case and a series of searches in "Adamas" are considered "routine" actions.

Previously, it was the Adamas group of companies that was entrusted with the production of medals for the Sochi Olympics. The metal for them was supplied by OJSC Prioksky Non-Ferrous Metals Plant. The director of the enterprise, Alexander Boguslavsky, concluded a contract that was obviously unfavorable for the plant with the structure of Sidorenko, Veremeyev and Weinberg, for which he was later sentenced to three years in prison.

[Vedomosti, 23.12.2016, Precious Suspicion: Investigative measures were also carried out in the Yashma jewelry group (also going bankrupt). Its leadership is suspected of evading payment of over 7 billion rubles. taxes according to a scheme similar to "Adamas". So in the summer of 2016 it was described by the representative of the interim manager of TPK Yashma, Kirill Sirotinsky: one-day firms entered into loan agreements for gold bars with a bank, thanks to which they did not pay VAT, and at the same time, contracts for the sale and purchase of bars - this was how the obligations were canceled. This is an old scheme, the tax authorities have learned to deal with it since the 1990s, the main thing is to prove fictitious, noted Oleg Konnov from Herbert Smith Freehills - sidebar K. ru]
