How to write a letter of resignation

To terminate the employment contract, write a letter of resignation. People most often quit on their own, but there are other conditions and reasons. The law does not establish a specific form for such an application, but certain rules are observed.

Important rules when writing a letter of resignation

Pay attention to important points:

  • the application for dismissal is written by hand with a pen. Do not use a computer for this. But some organizations practice writing a document on a computer:
  • Indicate in the document the reason why you decided to leave the job. But you have the right not to indicate the reason, and the boss cannot prevent you from leaving;
  • submit an application to the personnel department or the head of the enterprise no later than two weeks before the date of dismissal. Make a photocopy of the document. At your request, the personnel department is obliged to put a mark that they have accepted the application. If you work under a fixed-term contract, you have the right to write an application 3 days before the date of the upcoming departure from the position;
  • if you suddenly fall ill after filing the application, bring a sick leave to the personnel department. The term of dismissal will be reviewed, since according to the law it is impossible to dismiss a person on sick leave.

Writing the right letter of resignation

Enterprises may have a specific application form. In the personnel department, they can tell you how to write a document correctly. Write it from dictation, but it is better to be aware of this issue yourself.

Let's start writing the document:

  • take a blank sheet of A4 paper;
  • in the upper right corner write the full name of the director of the enterprise and the name of the company. Write in one line in the dative case. For example - "Director of OJSC "Verbena" Petrenko A.V.";
  • under the name of the head and the name of the company, write your personal data and position. For example - "archivist Ivanova L.S.";
  • under the "cap" write in the middle of the sheet from a new line with a capital letter the word "Statement";
  • under the title of the document, write the text of the statement with a capital letter and a paragraph in the following form: “I ask you to dismiss me from my position of my own free will (or for another reason, for example, by agreement of the parties) on July 25, 2016. Do not put the letter “c” before the date. The employee leaves on the last day of his employment. If you put this letter, the date of dismissal will be the previous day. If the planned date fell on a weekend, write the date of Monday;
  • at the bottom left, under the above text, put the date of writing. On the bottom right side, sign and write your last name with initials.

Take the document to the Human Resources Department. On the basis of the order, you will be paid all the necessary payments, they will give you a work book, a certificate of average wages and other documents required in this case, and in two weeks you will leave the enterprise.

Question about processing

There is no concept of working off in the Labor Code. But there is a clear indication in the law - a letter of resignation is submitted two weeks before the upcoming date of leaving the enterprise. During this time, the boss will find another employee to take your place. In agreement with the manager, you may not work for two weeks.

Be sure to go to work during these two weeks! You will not be paid settlement money for these days, and you will lose good relations with your boss. You may need a good review from a previous job.

What if I changed my mind about leaving my job after writing my resignation letter?

If you change your mind about leaving work, and the application is written, take the application from the personnel department before the end of the two-week period. If the boss hired another employee to take your place, nothing will work. You can't turn down a new employee.

The boss can dismiss an employee only on the basis of his written and signed application. Draw up the document correctly and make sure that it reaches the employer. If there is the slightest misunderstanding, contact a lawyer.
