What is a trade union?

Union

- uniting citizens in order to protect their rights and interests, improve working conditions and pay, find new ways to improve the quality of life and ensure social guarantees;

- legal and independent representative of employees in relations with the employer.

Today, the trade union is the only reliable support for workers and only it can really protect against threats of layoffs, illegal dismissals, non-payment of wages, etc.

The trade union unites the main categories of citizens:

- employees (a person who has reached the age of 14 and is engaged in labor activities under an employment contract);

- retirees (former employees who have retired, who were previously members of a trade union).

How to join a union?

It is very simple if your organization has a primary trade union organization. You just need to write an application to the trade union committee for admission to the trade union and to the accounting department - on the collection of trade union membership dues and transfer them to the trade union committee. A person is considered admitted to a trade union from the day a meeting or a trade union committee makes a decision on admission to a trade union. The proof of membership in a trade union is a trade union card, which is issued by the trade union committee and kept by you.

If your institution does not have a trade union organization, you can create it together with other, at least 3 people, employees.

Check out the By-Laws of the trade union and the by-laws of the primary trade union organization. After that, hold a constituent meeting, at which a decision is made to create a primary trade union organization, its governing and control and auditing bodies are formed. Each participant in the meeting writes an application to the trade union committee for admission to the trade union and in the accounting department - on the collection of membership dues.

In accordance with the Charter, admission to trade union members is carried out by primary trade union organizations, while the employee joins the Russian trade union of employees of state institutions and public services. The payment of trade union membership dues is the statutory obligation of a trade union member. According to the law on trade unions, the employer is obliged to transfer trade union dues to the account of the trade union organization free of charge if there are personal statements of the members of the trade union to collect dues from them.

The elected trade union committee and its chairman inform the Territorial Trade Union Organization of the creation of a primary trade union organization in the institution and apply for the organization to be registered with the trade union.

In accordance with the Federal Law "On Trade Unions" (Article 3), the primary trade union organization can act on the basis of a general regulation on the primary trade union organization of the respective trade union or adopt its own position on the basis of the Charter of the trade union. In the latter case, it is necessary to add the question "On the regulation on the primary trade union organization ___________" to the agenda of the meeting.

The course of the meeting and the content of the minutes depend on the form of voting in the elections of trade union bodies - open or closed (secret). This sample protocol assumes that elections are held by open ballot.

The trade union is an INDEPENDENT UNION OF EMPLOYEES united for the organized expression of their interests and collective protection of their rights, rights and dignity of each member of the trade union organization.

At the REGIONAL level - Trade unions, within the framework of the regional tripartite commission for the regulation of social and labor relations, conclude a THREE-WAY AGREEMENT between regional associations of trade union organizations, regional associations of employers and the Government of the Kaluga Region in order to create, based on the principles of social partnership, conditions for the economic development of the Kaluga Region, the observance of legal rights and the interests of workers, social peace and stability on the territory of the Kaluga region

At the INDUSTRY level - Trade Unions enter into an INDUSTRIAL TARIFF AGREEMENT (SAT) with Employers' representatives. They put forward their proposals for solving urgent acute problems of the industry (minimum standards for the contractual period for wages, social conditions for workers, higher in comparison with labor legislation, or not defined by it).

At the level of the ENTERPRISE - Trade unions negotiate and conclude a COLLECTIVE AGREEMENT with the Administration, which details the specific wages and working conditions, social benefits and relationships, mutual obligations of the parties for the contract period, which cannot be lower than in the UTS. They stipulate the conditions of labor protection and health improvement of workers and their families, ways of solving the housing problems of members of the trade union.

How to join a union?

It is very simple if your company has a primary trade union organization (hereinafter referred to as primary). You just need to write an application to the trade union committee for admission to the trade union and to the accounting department - on the collection of trade union membership dues and transfer them to the trade union committee. A person is considered admitted to a trade union from the day a meeting or a trade union committee makes a decision on admission to a trade union. The proof of membership in a trade union is a trade union card, which is issued by the trade union committee and kept by you.

If your enterprise does not have a trade union organization, you can create one together with other, at least 3 people, employees.
Check out the By-Laws of the union you wish to join and the by-laws of the primary union organization. After that, it is necessary to negotiate with the territorial (city, district) organization of this trade union about the desire to create a primary trade union organization at your enterprise.

If there is no territorial organization, you need to contact the Central Committee of the trade union directly.
If the territorial organization of the trade union (trade union) makes a decision to establish a primary trade union organization, a constituent meeting is held, at which a decision is made to create a primary organization, its governing and control and auditing bodies are formed. Each participant in the meeting writes an application to the trade union committee for admission to the trade union and in the accounting department - on the collection of membership dues.

How to become a member of a trade union and what is needed for this?

There are two types of union membership: associated and valid members.

Valid members pay union dues of 1% of wages and are entitled to enjoy the full protection of our union, including benefits, legal assistance, etc.

Associates members do not pay anything. They have the right to provide legal advice and protection of their interests when hiring and firing. Associate members are not subject to clauses 3.4.2., 3.4.3, 3.4.4, 3.4.7, and 3.5.3 .

Extract from the charter:

A full member of a trade union can be anyone working in an enterprise, in an institution and organization of all forms of ownership, performing medical or medical-related work or serving these works, studying in educational institutions for professions to perform these works, a non-working pensioner of the industry, recognizing the Charter of the trade union, paying membership fees and fulfilling the decisions of the trade union, except for employers and their representatives ( 87th ILO Convention).

3.2. Admission to trade union membership is carried out by the primary trade union organization upon written application.

Trade union members are registered with the primary trade union organization at their place of work, study or residence. They fill out a registration card and issue a trade union card.

3.3. For workers who have transferred from other trade unions, employed in seasonal work, during their service in the Armed Forces of the Russian Federation, the experience of trade union membership is preserved.

The right to membership is retained for women who temporarily stopped working in connection with raising children, retirees, as well as workers who lost their jobs due to staff cuts (number), before getting a permanent job.

3.4. A trade union member has the right to:

3.4.1. For free legal assistance and protection from the trade union in state and economic bodies in matters of labor relations, labor safety, health improvement and other social and labor rights and interests.

3.4.2. Apply to the relevant bodies of the trade union with questions, statements, suggestions and demand an answer on the merits of your appeal.

3.4.3. The preferential use of the cultural and sports facilities of the trade union, obtaining a voucher for oneself and family members for sanatorium treatment and recreation in the health resort of the trade union, as well as benefits established by the trade union or its affiliates.

3.4.4. Elect and be elected to trade union bodies.

3.4.5. Leave the trade union on the basis of a personal statement.

3.4.6. Personally participate in meetings, conferences, congresses, meetings of trade organizers when considering the issue of his activities or behavior.

3.4.7. For material assistance, the use in the prescribed manner of property and material resources of the trade union.

3.4.8. To freely discuss at trade union meetings, conferences, meetings of trade union committees, in the press and other media, all issues of trade union activities, make proposals, speak out openly and defend their opinions, criticize any trade union body and its members, receive information about the work trade union organizations and their leaders.

3.4.9. Participate in the resolution of a collective labor dispute and other collective actions, incl. strikes under the protection of the union.

3.5. A trade union member is obliged:
