By the decision of the magistrate of the judicial district No. 7 in the Leninsky district of Ufa dated February 05, 2014. Director of the Bashneft-Ufaneftikhim branch of OJSC Joint Stock Oil Company Bashneft Polunkin Ya.M. found guilty of committing an administrative offense under Part 1 of Art. 19.5 of the Administrative Code of the Russian Federation with the imposition of a penalty in the form of a fine in the amount of 1,000 rubles.

Disagreeing with this resolution, YM Polunkin, Director of Bashneft-Ufaneftikhim, a branch of Bashneft Joint-Stock Oil Company, OJSC filed a complaint in which he indicates that the order was illegal in terms of the established time limits and therefore considers the decision of the magistrate to be canceled.

The representative of the complainant - N.N. Gabdrakhmanov. at the hearing he supported the arguments of the complaint and asked to be satisfied in full.

Representative Office Federal Service for supervision in the field of nature management (Rosprirodnadzor) in the Republic of Bashkortostan A.K. Ponamareva considered the complaint unsubstantiated and not subject to satisfaction.

After checking the case materials and evaluating the arguments of the complaint, the court comes to the following.

In accordance with Part 1 of Article 19.5 of the Code of Administrative Offenses of the Russian Federation, an administrative offense is the failure to comply with a legal order (decree, submission, decision) of the body (official) exercising state supervision (control) to eliminate violations of the law within the prescribed period.

The Rosprirodnadzor Administration for the Republic of Bashkortostan, based on the results of the audit, issued a prescription №№ from DD.MM.YYYY to JSC ANK "Bashneft" with a due date of 12/01/2013.

By the decision of the magistrate of the judicial section No. 7 in the Leninsky district of Ufa dated 05.02.2014, the director of the branch of OJSC Joint-Stock Oil Company Bashneft Bashneft-Ufaneftikhim Polunkin Ya.M. found guilty of committing an administrative offense under Part 1 of Art. 19.5 of the Administrative Code of the Russian Federation with the imposition of a penalty in the form of a fine in the amount of 1,000 rubles

In accordance with part 1 of article 1.5 of the Code of Administrative Offenses of the Russian Federation, a person is subject to administrative responsibility only for those administrative offenses in respect of which his guilt has been established.

According to the evidence provided by Bashneft, OJSC, upon receipt of the order, a tender procedure was organized to select a contractor to conduct an inventory of emissions of harmful substances into the atmosphere and their sources, and develop a draft maximum permissible emissions (MPE) standards. Based on the results of the tender procedures, the winner of LLC NVP "Tekhnoresurs" was selected. A draft contract was developed and agreed with the counterparty and, in accordance with the procedure for signing contracts, measures were taken to check the counterparty (LLC NVP "Tekhnoresurs") by the security service of the legal entity. The contract was signed on March 28, 2013. and transferred to work in LLC NVP "Tekhnoresurs". 16.07.2013 the developed draft standards were sent for examination to the FBUZ "Center for Hygiene and Epidemiology in the Republic of Bashkortostan". 19.08.2013 an expert opinion was received on the compliance of the draft MPE standards with state sanitary and epidemiological rules and regulations. On 23.08.13, the draft MPE standards were sent to the Rospotrebnadzor Administration for the Republic of Bashkortostan to issue a sanitary and epidemiological conclusion. 11.10.2013 The company received a sanitary and epidemiological conclusion on the compliance of the draft MPE standards with state sanitary and epidemiological rules and regulations. 21.10.2013 application for approval of the draft MPE standards, in established order was directed to the approval and establishment of maximum permissible emission standards for emission sources of the Bashneft-Novoil branch of ANK Bashneft to the Office of Rosprirodnadzor in the Republic of Bashkortostan.

The draft MPE standards were not considered by the Rosprirodnadzor Administration for the Republic of Belarus (the body that drew up the protocol on the administrative offense) by the time the court considered the materials of the case on the administrative offense. In this regard, the Company at the time of the court's decision was not able to apply for a permit for the emission of harmful substances, since according to the order of the Ministry of Natural Resources of the Russian Federation of July 25, 2011 No. 650, this application must be accompanied by the standards for maximum permissible emissions in accordance with the approved draft MPE standards by the Rosprirodnadzor Administration for the Republic of Belarus (which, in turn, at the time of the consideration of the administrative case by the court, was issued to the Company only on 10.02.2014).

Within the meaning of Article 30.6 of the Code of Administrative Offenses of the Russian Federation, when the courts consider a complaint against a decision in a case of an administrative offense, the verification of the legality and validity of bringing to administrative responsibility must be carried out in full by the courts of each instance.

From the mentioned rule of law follows a direct indication that the order of the administrative body must meet the condition of legality. Consequently, an essential circumstance to be clarified when considering a case on challenging a decision on an administrative offense is the establishment of the legality of an order, the failure of which was imputed to society. Thus, the establishment of this circumstance determines the resolution of the issue of the presence or absence of an event of an administrative offense.

The enforceability of the prescription is another important requirement for this type of non-normative legal act, since the prescription comes from a state body with powers of authority, is mandatory and for its execution a period is set for violation of which administrative responsibility comes. The enforceability of the order should be understood as the existence of a real opportunity for the person brought to justice to eliminate the identified violation within the specified period.

By virtue of part 2 of article 2.1 of the Administrative Code of the Russian Federation entity is found guilty of committing an administrative offense if it is established that he had the opportunity to comply with the rules and regulations, for violation of which administrative responsibility is provided, but this person did not take all the measures in his control to comply with them.

In the case under consideration, Bashneft Joint-Stock Oil Company took all measures depending on it to comply with the order.

From the literal interpretation of the disposition of Part 1 of Article 19.5 of the Code of Administrative Offenses of the Russian Federation, it follows that the objective side of the composition of an administrative offense provided for by it consists in the failure to fulfill, within a specified time, an exclusively legal order of the body (official) exercising state supervision (control) to eliminate violations of the law ...

Thus, the court considers that the appealed decision of the magistrate is to be canceled, and the proceedings on the case must be terminated due to the absence of an administrative offense.

Guided by Article 30.6 - 30.7 of the Administrative Code of the Russian Federation, the court
